Damages recovered for injuries arising as a result of a negligent prescription of incorrect medication

Our client received Enalapril medication 10mg to assist in reducing his blood pressure.

Our client attended the Lloyds pharmacy, 30 Church Road, Garston, L19 2LW, for his prescription of Enalapril 10mg. Our client was negligently prescribed Escitalopram 10mg tablets, rather than his usual prescription of Enalapril 10mg tablets. Our client took the medication home and began taking the same.

After taking the prescribed medication our client began to experience the following symptoms: dizziness, nausea, diarrhoea, agitation, anxiety, lethargy, sore joints, muscle aches, aching limbs, general feeling unwell, night sweats, dry mouth and shortness of breath.

Our client assumed he had food poisoning or something similar and that the symptoms would pass. He rested at home. Or client did not acknowledge he had been taking the wrong medication until approximately 35 days after the prescription.

After multiple consultations with his GP, the deceased was prescribed the following medication over the course of the next 8 weeks: Prochlorperazine (to address vertigo), Diazepam (to address agitation) and Stemetil (to address vertigo).

The symptoms of the prescription error gradually improved over the course of 3 months.

In the interests of limiting costs, at client’s instruction, a letter of claim was sent to the defendant in the absence of expert evidence and we negotiated a settlement on behalf of our client without the need to commence Court Proceedings.
