Summary

Gregory Abrams Davidson Solicitors took over a claim from Defendant Solicitors as the Claimant was unhappy with the offer they made and the way his case was handled. We were able to recover a significant increase on the Defendants previous offer which our client was delighted with.

Facts of the case

We were instructed by a claimant who was riding his bicycle on a main road in Speke area of Liverpool, when a car had emerged from a side road causing a collision.

Our client sustained soft tissue injuries to his knees, face and back along with cuts and bruises all over his body.

His bike required repairs and he had suffered some loss of earnings.

Case Progression

The insurers for the third-party car driver persuaded Mr D that it would be in his interest and faster to have them deal with his claim, despite them representing the defendant driver.

Liability was admitted quickly, however the Solicitors dealing with the case on behalf of the Defendant’s Insurers obtained medical evidence before his injuries were fully known and then refused to accept any symptoms not included in the report they had obtained.

He was offered £3025.36 as a global sum.

Mr D was concerned that he was being under-compensated and being treated unfairly, so instructed us to review his case.

We assessed the evidence and we were able to obtain a more favourable report that dealt with all the client’s injuries fully and provided a clear prognosis.

We were then able to re-negotiate a settlement that fully compensated the Claimant in the sum of £9071.16, almost three times the amount the defendants solicitors were offering him.

Gregory Abrams Davidson Solicitors commented that “People should be wary about having those who represent the very persons who injured them, dealing with their cases. Surely they can’t serve those who caused the accident and the innocent victims as fairly as they may like. Instructing your own solicitors means they are independent and act for you and nobody else. They only serve your best interests. We were pleased to be able to achieve a significant increase on the settlement previously offered, which was a good result for our client that he was delighted with.”
