Facts of the case

We were instructed by a claimant who had been the passenger of a taxi struck by another vehicle whilst it was performing a U-Turn on Queens Drive, West Derby Liverpool.

The other vehicle was travelling at such speed it caused the taxi to spin off the road.

Despite her serious injuries which included a head injury, displaced clavicle, fractured ribs, displaced fracture of her sternum and a left sided pneumothorax, our client removed herself from the car as it was smoking and she feared it would catch on fire.

The Claimant was treated by paramedics at the scene before being taken to hospital.

Case Progression

Initially, the insurers for the car driver refused to admit any liability, but we were able to gain enough evidence that they had little choice.

However, despite the Claimant making a good recovery from her multiple fractures, we were concerned that she was developing widespread pains that were exhausting her and causing restrictions both at home and at work.

We were able to arrange for her to be seen by several specialists, who diagnosed the claimant as suffering fibromyalgia, a chronic pain syndrome which can be both permanent and debilitating.

Her diagnosis was rejected by the Defendants and their experts, but ultimately our handpicked specialist’s prevailed and we secured the Claimant a settlement of just under £100,000 plus her legal costs.
