A Hospital / GP or other Healthcare provider can either as a result of specific complaint made to them or because of a specific event undertake an investigation. The event could for example be an unexpected or avoidable death or avoidable injury or harm.
The complaint will normally be department led or commissioned by Clinical Governance who will involve the necessary clinical specialists.
Any investigation will focus on an investigation to establish the facts regarding the care and treatment, review any relevant documents, conduct interviews where appropriate and identify any key learning with the aim of using this information to reduce the likelihood of future poor patient experience or injury.

Often we are instructed in cases in which the investigation report concludes that the care was adequate or that whilst there were some failures the eventual injury or death could not have been avoided. Please remember that the Hospital investigation is not an independent process and those reviewing the care and outcome are normally employed by the Hospital. We have succeeded in bringing successful claims for medical negligence and recovered substantial compensation and apologies for our clients even when the hospital investigation concluded the care was reasonable or the injury / death could not have been prevented. Therefore simply because the Hospital refuses to acknowledge failures in their investigation report does not mean there has not been negligent treatment resulting in a significant injury or death.
