Recovery of damages for client who suffered injuries as a result of a fall in hospital

Our Client was admitted to hospital and assessed as a high risk of falls and

was to be Supervised on a 1:1 basis and with cot sides raised. She was however

left unsupervised with the cot sides down and fell out of bed. She sustained several rib fractures, a significant chest injury and hospital acquired pneumonia causing respiratory failure.

A Letter of Claim was sent to the Hospital and liability was admitted in full. We achieved a negotiated settlement without the need for court proceedings.

Damages were predominately for pain, suffering and loss of amenity as our client had no loss of earnings claim and only a small claim for additional care.
