During the course of her employment a patient approached our client from behind and punched them in the side of the head, causing them to fall to the floor and lose consciousness. Our client suffered from permanent damage to her hearing as well as headaches and earaches and was initially afraid to return to work.
We were able to establish that our client’s employer was negligent in failing to prevent the patient from assaulting our client. They had chosen to ignore a known risk of injury presented by the patient in question. By requiring our client to work with the patient when it was unsafe to do so they had also failed to provide our client with a safe system of work. Our client’s employers had not taken adequate care for their safety and had exposed them to a foreseeable risk of injury.
We recovered damages in excess of £35,000.00, including loss of earnings as well as Pain, Suffering and Loss of Amenity for the damage to our client’s hearing and the additional pain and anxiety caused to our client.
