Damages for client who suffered injuries as a result of a surgical procedure

Settlement Report

Name of case (anonymised) D v Southport & Ormskirk NHS Foundation Trust

Facts of case

Our Client required a simple biopsy to be taken from her throat. Unfortunately she suffered pain during the procedure, including the close up procedure and subsequently her wound dehisced necessitating further treatment.

A Letter of Claim was sent on our Client’s behalf to the Hospital Trust alleging that the biopsy was inappropriately performed.

The Trust responded admitting that the surgical procedure was substandard and as a result accepted that our client had suffered unnecessary additional pain and suffering. Following a short period of negotiation settlement was agreed between the Parties.

Quantum     £2,500.00
