Settlement Report
Name of case: O v Liverpool University Hospitals NHS Foundation Trust
Facts of the case
Gregory Abrams Davidson Solicitors represented a client in relation to a claim for medical negligence against Liverpool University Hospitals NHS Foundation Trust. Our Client attended the Defendant Trust for breast surgery. During the course of the surgery a guidewire was lost and could not be located. All appropriate techniques were used to locate and retrieve the guidewire, including on table radiology. The negligent act was the failure to advise our client about the existence of the retained guidewire. Our client was simply discharged without being informed. Our client attended her GP practice complaining of pain but was reassured that this would simply be attributable to the surgery she had been subject to and was provided with pain relief. Due to ongoing pain our client was taken by ambulance to accident and emergency, where the guide wire was located and removed.
Whilst surgery would always have been required to remove the guidewire, we recovered damages for the additional pain and anxiety caused to our client.
