Damages recovered for injuries and losses following a tragic death caused by a medication error

AB v Liverpool University Hospitals NHS Foundation Trust

Our evidence concluded that the death was caused by the Defendant hospital’s negligence in respect of the prescription of penicillin causing an extreme allergic reaction.

The Client’s father was elderly, frail and suffered from hypertensive heart disease.  Unwell he was taken by ambulance from the care home where he was resident to the Emergency Department of the Liverpool University Hospital.  He was known to be allergic to Penicillin and had only been discharged the previous day from the same hospital.  In error he was administered Penicillin and suffered an extreme allergic reaction.  He died 10 days later.

 

The Coroner following an Inquest concluded that AB had died from heart disease complicated by an adverse drug reaction.

 

A Letter of Claim was sent to the Trust.  In their Letter of Response the Trust admitted Penicillin had been administered in error but denied this had caused AB’s death.

 

Gregory Abrams Davidson Solicitors obtained independent evidence from a medical expert in the care of the elderly who provided a report in which he concluded that the drug reaction (and its subsequent treatment with high doses of steroids) would have caused an acute deterioration in the cardiac failure suffered by AB and that this is likely to have caused his death.

 

A Barrister was instructed to prepare formal pleadings which are referred to as Particulars of Claim and which were based on the medical evidence already obtained.  These formal Pleadings were sent to the Trust with supporting documents and an offer to settle the claim.

 

Following negotiations and without the need to commence Court proceedings a settlement was reached in which the Defendant agreed to pay our Client who was acting on behalf of the estate damages for pain and suffering and funeral expenses as well as their legal costs.
