GAD Legal Solicitors recover damages for injuries arising as a result of a district nurse failure to refer a patient suffering from an ischaemic foot

Facts of the case

AB was frail and elderly when he developed a blister on one of his toes which was not healing. He attended a walk-in-centre where it was noted that the foot was red and swollen and that AB walked slowly with a stick. Antibiotics were prescribed and it was arranged that District nurses attend AB at home to dress the foot. However, gangrene developed necessitating amputation of the toe.

GAD were instructed to conduct a claim in clinical negligence. The medical records were obtained and expert evidence from experts in nursing and vascular surgery.

A claim was brought relating to the district nurse care in that there was a failure to recognise that the wound was not only failing to heal but that it continued to deteriorate. It was alleged that given AB’s extreme vulnerability as a result of co-existing health problems which included advanced age, frailty, peripheral vascular disease, chronic back pain, cognitive impairment, history of cerebrovascular accident, heart failure, hypertension, myocardial infarction, atrial fibrillation, arthritis, and low BMI early intervention was necessary to prevent the development of complication, such as did develop, including necrosis and gangrene.

A letter of claim was sent to the Defendant. The Defendant in their response made admissions as to liability and following negotiations settlement was reached and damages paid.
