Civil Litigation Funding Reforms

Parliament will soon consider reforms of civil litigation funding and costs in England and Wales.

 

Under the new proposals, a proportion of the costs in bringing a case for personal injury will be taken from damages awarded to the injured person.

 

We object to that proposal. Damages are carefully calculated to put an injured person in the position he or she would be in but for the accident, as far as money can and so any deduction is both unfair and contrary to the established legal principle that a wrongdoer must be held responsible and accountable for the wrong.
